Efektivitas Wilayatul Hisbah dalam Pemberantasan Judi Online Analisis di Kota Banda Aceh

This research examines the effectiveness of Wilayatul Hisbah’s (WH) role in combating online gambling practices in Banda Aceh, particularly during the 2024–2025 period, when the number of cases showed a significant increase. As a region that fully enforces Islamic law, Banda Aceh faces serious challenges with the advancement of digital technology, which enables people to access gambling sites discreetly through personal devices and public internet networks. This phenomenon not only violates Islamic legal provisions but also creates social problems such as family disharmony, economic pressure, and rising criminal activity.The study employs a qualitative method with a juridical-normative approach, analyzing the legal norms regulating maisir (gambling) under Aceh Qanun No. 6 of 2014 on Jinayat Law and related regulations, while linking them to the implementation of law enforcement by WH in practice. The data sources include primary legal materials, academic studies, official reports, and interviews with relevant authorities.The findings indicate that although WH has undertaken various efforts—such as routine patrols, joint operations with the police, website blocking in cooperation with the Department of Communication and Information, and public legal awareness campaigns—the number of online gambling practices continues to rise. Based on Soerjono Soekanto’s theory of legal effectiveness, two dominant factors weaken law enforcement. First, the existing regulations do not explicitly cover digital-based gambling, allowing offenders to exploit legal loopholes and evade sanctions. Second, WH’s limited human resources, technological facilities, and budget constrain the scope of monitoring. Nevertheless, cross-institutional cooperation and preventive strategies through community education are progressive steps that should be expanded. Therefore, the effectiveness of eradicating online gambling in Banda Aceh will be more optimal if regulations are strengthened, WH’s institutional capacity is enhanced, and active community participation is continuously mobilized in upholding Islamic law.
