Tinjauan Hukum Terhadap Pemenuhan Hak Anak Miskin dalam Mendapatkan Pendidikan yang Layak di Aceh

This research is motivated by the high poverty rate in Gampa Village, which impacts the fulfillment of children's rights, particularly the right to a living in education. Economic limitations in poor families leave children vulnerable to dropping out of school, although parents are still legally obligated to provide their children with the right to education until they are independent. This study aims to analyze the practice of fulfilling children's right to a living in education in poor families, the inhibiting factors, and the role of the village government in guaranteeing children's right to education. The method used is field research with a qualitative sociological-normative approach through interviews, observation, and documentation. The results show that fathers as heads of families are often unable to provide for their children's educational needs due to unstable and low incomes, resulting in a gap between legal provisions and social reality. The village government plays a role through assistance and scholarship programs as a form of social intervention. This study concludes that the fulfillment of children's right to a living in education is not solely limited by age, but is determined by the child's actual condition, such as the continuity of education and the child's inability to meet their educational needs independently, and requires ongoing support from the local government.
