Abstract

The escape of inmates from Lambaro Correctional Facility (Lapas) constitutes a serious violation that not only threatens prison security but also public order. In practice (das Sein), escape cases—including the mass breakout of 113 inmates in 2018—reflect weaknesses in security systems and internal prison conditions, such as overcrowding, psychological pressure, and lack of effective rehabilitation programs. Normatively (das Sollen), inmate escapes are regulated through several legal frameworks, namely Law Number 22 of 2022 on Corrections, Article 223 of the Indonesian Criminal Code (KUHP), Government Regulation Number 32 of 1999, and the Regulation of the Minister of Law and Human Rights Number 6 of 2013, which stipulate disciplinary, administrative, and additional criminal sanctions for escapees. This study uses a juridical-empirical method with a sociological legal approach, involving interviews with prison officers and direct observation. The findings indicate that post-2018 sanctions have been relatively effective in creating general deterrence, but individual deterrence remains limited due to the absence of specific criminal provisions on escape and the suboptimal prison conditions. In the perspective of Islamic law, sanctions for escape can be categorized as ta'zir, namely punishments determined by the ruler to uphold public interest. Thus, the imposition of sanctions on escaped inmates can be strengthened through a ta'zir-based approach that is educational, repressive, and corrective—not only punishing but also rehabilitating and preventing repeat offenses.
