Abstract
This research is motivated by observational data which shows land sale and purchase transactions without making a Sale and Purchase Deed (AJB) from the Land Deed Making Officer (PPAT), as the AJB is an authentic deed that proves the transfer of old ownership rights to new ownership. AJB is also a mandatory requirement for changing the name of a land certificate. This often happens in Kutapanjang District, Gayo Lues Regency. Responding to this practice, researchers conducted action research at the Gayo Lues National Land Agency office to improve orderly land administration. The objectives to be achieved in this research are: knowing the process of transferring ownership rights to land through buying and selling in Kutapanjang District, Gayo Lues Regency and knowing the role of the Gayo Lues National Land Agency in efforts to increase registration of uncertified freehold land for the sake of orderly land administration, and as a form of legal awareness of the importance of land certification, whether changing names or registering land for the first time. This research uses an empirical juridical approach and qualitative research type, with observations and interviews of Gayo Lues National Land Agency staff and the local community, then combined with literature data. This research measures the implementation of the transfer of ownership rights to land through buying and selling based on Government Regulation Number 24 of 1997 concerning Land Registration in Kutapanjang District, Gayo Lues Regency. The research results show that the majority of people do not yet have land ownership certificates. This is due to low public awareness of the importance of registering land for the first time or changing a name. This is because people only adhere to handwritten letters. When transferring property rights, the community did not proceed to the stages of making a sale and purchase deed so that the BPN could not make a certificate. Land without a certificate of ownership is a common occurrence which means that orderly land administration in Kutapanjang District, Gayo Lues Regency is not fully running well and of course has legal risks in the future.
