The government has made several policies to anticipate the negative impact of tobacco distribution. The policies did not positively contribute to the decline in tobacco consumption rates, especially in the Sabang Free Trade Area in the Context of Aceh. This research is aimed at the illegal tobacco control policy in Sabang District-Aceh. The method used for this research is qualitative methods, through in-depth interviews with several key informants. The findings of this research indicate in Law No. 37 of 2000 that BPKS regulates control through a licensing mechanism and Customs controls through a monitoring mechanism. In addition, this research has found that the decision on quota mechanism for tobacco distribution in the Sabang Free Trade Area is merely referring to the request of the importers and it has not been regulated in the detailed regulations of the head of the BPKS. Therefore, the the chance that this tobacco distribution to be illegally distributed and sold outside Sabang Free Trade Area is very high. Thus, illegal tobacco distribution is partially considered as one of so many problems found in the implementation of Sabang Free Trade Area. This research suggested that the supervisory mechanism in this area needs to be seriously supported to overcome these problems such as providing legal certainties and clarity between the overlapping regulations, including the quota decision and supervisory mechanism with a clearer arrangement of the instruments.
