Abstract

Child protection as victims of criminal acts constitutes a crucial issue in family law, as it concerns the fulfillment of children’s fundamental rights and the shared responsibility of the state and the family. This article aims to analyze the practice of protecting child victims of violence at the Aceh Regional Technical Implementation Unit for Women and Children Protection (UPTD PPA Aceh) from the perspectives of family law and Islamic law. This study employs an empirical juridical method with a qualitative approach, combining the analysis of statutory regulations with in- depth interviews conducted with officers of UPTD PPA Aceh. The findings indicate that UPTD PPA Aceh has implemented child protection through an integrated service mechanism encompassing complaint intake, risk assessment, emergency protection, legal assistance, as well as psychological and medical recovery services. These practices are in line with Law Number 35 of 2014 on Child Protection and Law Number 12 of 2022 on Sexual Violence Crimes, and reflect the principle of the best interest of the child as well as the values of maqāṣid al-sharī‘ah, particularly hifz al-nafs and ḥifẓ al-nasl. Nevertheless, the effectiveness of child protection remains constrained by limited resources, weak family support, social stigma, and suboptimal cross-sectoral coordination. This study demonstrates that the success of child protection depends not only on the strength of regulatory frameworks but also on institutional capacity and family involvement in supporting the recovery process of child victims of violence.
