Perspektif Hakim dalam Menjatuhkan Uqubat Ta’zir Terhadap Anak Pelaku Pemerkosaan dalam Putusan Mahkamah Syar’iyah Nomor 1/JN.Anak/2023/Ms.Bna

This study analyzes judicial considerations in imposing uqubat ta’zir on child perpetrators of rape in the Banda Aceh Syar’iyah Court Decision Number 1/JN.Anak/2023/MS.Bna. Using normative legal research, this study examines how judges balance juridical and non-juridical aspects. Findings indicate that judges prioritize the best interest of the child and restorative justice. Juridically, the actions fulfilled Article 50 of Aceh Qanun No. 6/2014, supported by Visum et Repertum and the victim's psychological trauma. Despite higher prosecutorial demands, judges exercised ta’zir discretion to impose 24 months of rehabilitation at LPKA. This decision adheres to Article 67 of the Jinayat Qanun, limiting sentences to one-third of the adult maximum. The study concludes that while the verdict aligns with the juvenile justice system, greater transparency is needed to ensure proportional justice for victims facing permanent trauma.
