Pengabaian Pengawasan Orang Tua terhadap Penggunaan Smartphone Anak: Analisis PP Nomor 17 Tahun 2025 di Kota Banda Aceh

Abstract: This study examines parental neglect in supervising children's smartphone use in Banda Aceh City and its relevance to Government Regulation Number 17 of 2025 on Child Protection in Digital Spaces, viewed from the perspective of family law, both positive law and Islamic family law (the concept of hadhanah). This research uses a qualitative field research approach, supported by statutory and conceptual approaches. Primary data were obtained through semi-structured interviews and non-participatory observation of four informant families in Banda Aceh City, while secondary data were drawn from legislation, books, and scientific journals. The results show that parental supervisory obligations, as regulated in Article 45 of Law Number 1 of 1974 and Article 26 of Law Number 35 of 2014, and consistent with the hadhanah concept in Islamic family law, are normatively understood by the informant families but not yet fully and consistently implemented. Neglect occurs in three interrelated forms: neglect of time, content, and companionship, accompanied by an imbalance in supervisory roles between fathers and mothers. Based on Article 76B in conjunction with Article 77B of Law Number 35 of 2014, the four cases do not yet fulfill the element of total abandonment required for the criminal offense of neglect, but can still be interpreted as a broader form of neglect when viewed from the principle of the best interests of the child. This study recommends strengthening continuous socialization and family law education, including through religious institutions, as a priority before resorting to criminal sanctions.
